Tax Process

At the Law Office of Murray Greiff, we want you to understand your options and the legal situation. We meet with clients to provide an up front analysis of the tax matter. We examine the money value, comparing the tax deficiency to the cost of the audit. Depending on the type of audit, we can work with your CPA or other professional.

Attorney Murray Greiff provides counsel and gathers the necessary documents to interface with the IRS or state agency on your behalf. If, after the audit the deficiency is upheld, we can continue representation in a tax appeal or collection case.

Tax Collection Cases

• Offers in compromise: Based on an individual inability to pay, we write an agreement to settle the taxpayer's tax liability for less than the full amount.
• Installment payment plan: Based on your ability to make regular payments over time, we will create a payment plan with realistic installment amounts; you must agree to keep current on the payments and all current taxes during the years of the plan.
• Innocent spouse: When underpayment of taxes is wholly the fault of one spouse, if the other spouse — the innocent spouse — can prove he or she had no knowledge of, and no reason to know of, the underpayment, we will seek to have the innocent spouse excused from tax liability.
• Bankruptcy: In limited circumstances, bankruptcy may relieve some tax liability.
• Abatement of interest and penalties: In limited circumstances, we can seek abatement of tax interest and penalties.

Federal and State Tax Litigation

Before entering litigation, we evaluate the cost of proceeding, the prospects of settling and the likelihood of success at trial. We will represent clients if we handle the audit, but also welcome clients whose need for an attorney arises after the audit, at the appeal or in litigation.

Clients issued a notice of deficiency have 90 days to file the tax court petition. This deadline cannot be extended, and you will receive a tax bill after 90 days.

In order to appeal to state court, you must pay the tax before the court will review findings. However, you will not be required to pay the disputed tax before appealing to tax court.

Criminal Tax Defense and Tax Fraud

We represent businesses charged with tax fraud, including claims of unreported income or overstating deductions. In the near future, this may also increasingly include charges of failure to pay withholding taxes. We represent individuals, corporations and individual taxpayers.
